What's bad about his bill is that it gives game store owners every incentive to NOT enforce ESRB ratings... because if they try, and slip up, they'll get fined. When retailers stop trying as a result, Whacko Jacko can then claim that the ebil, ebil gamerz are trying to pervert your children... and start the hype train rolling on banning game content. He's crazy, and his legal tactics are blatently stupid, but he does have a rationale behind his moves that isn't entirely in the realm of the moonbat. I t basically means that, if the stores say they'll do what they already do (not sell M rated games to kids) and then do any way, they can be sued. Thing is, that would just make them stop doing that altogether; you can't get sued for lying about that if you don't restrict game sales at all. | |

As noted above, what he's trying to do is foist a degree of liability on retailers that's an order of magnitude beyond common sense, and a disincentive to actually implementing any store policies to enforce the ESRB. While some stores do have policies about ESRB based age checks, they're just that, store policies and nothing more, and various state attempts to enact legislation to make them legally enforceable have generally failed. Part of the reason for that, is that there's generally two grades of id/age verification. The first is strict verification, where the retail establishment is legally liable for any failures, ie booze retailers, and the second is casual verification, where the establishment makes a good faith effort, but should little Timmy come home with a copy of GTA IV, the most the store is on the hook for is a sincerely worded apology from the CEO's executive assistant, a writeup in the sales clerk's folder, a $5 coupon for the food court, and, until recently, a nuisance lawsuit from JT. Another point that's caused such legislation to fail, is that a store generally has no way of knowing whether a child's parent approves or disapproves of any given title. I'm sure there are far more parents in this country who would be upset that their precious babykins was denied Saw XVIII: The Game, than there are parents who would be upset that little Timmy was able to bring home a copy of GTA IV. | |

I'm so glad the gaming industry finally did what every other American industry does and hired lobbyists. I mean, Jack Thompson was always going to be marginalized (he's completely pants) but at least the industry isn't getting harassed by the politicians anymore. | |
One of the reasons I stay at this site is for this kind of reporting, I haven't on any other gaming site read anything of this depth or with this much research about JT. I am pretty amazed and pleased to hear about the Huntsman guy who vetoed this bill, he seems to be one of the first politicians looking at this smartly and not being sucked into the child-danger issues. Not to say that they aren't valid issues, but they are blown far out of proportion, especially by good ol' Jack, so to see him actually consider what the bill would cause is, to me, fantastic. | |
