For those who are curious (because I love Constitutional law), I now present for you the facts behind the only significant court case to be directly relevant to the Third Amendment: Engblom v. Carey.

In 1979, prison officials in New York organized a strike; they were evicted from their prison facility residences, which were reassigned to members of the National Guard who had temporarily taken their place as prison guards. The United States Court of Appeals for the Second Circuit ruled: (1) that the term "owner" in the Third Amendment includes tenants (paralleling similar cases regarding the Fourth Amendment, governing search and seizure), (2) National Guard troops count as soldiers for the purposes of the Third Amendment, and (3) that the Third Amendment is incorporated (that is, that it applies to the states) by virtue of the Fourteenth Amendment.

Gods I love LRR.

Sadly, this makes congress' understanding of the bill of rights look silly.

Unless I'm mistaken, the Constitution wasn't written until after the Articles of Confederation failed, so we were already a country at that point, albeit a failed one.

It's kind of weird, because before the Constitution was actually ratified, the bill of rights also had to be ratified.

That brings up an interesting point--are homonyms protected? When we get to that point, is each American protected, under the highest authority in our country, to genetically splice bear arms onto our shoulders?

Hmm, I didn't really enjoy that episode to be frank.

Paul didn't say anything for one thing, Graham wasn't even there and the same thing got repeated too many times, just made it a bit boring for me, oh well, it was free so I don't care.
