They're not intended to be an attack on free speech, but that is how some use it these days. As with anything put in place to protect us, there is always an asshole looking to turn it to his advantage. Criticizing a game is neither slander nor libel if there are no lies, but that doesn't stop them from suing under those pretenses.

Libel:

Law.1.a. defamation by written or printed words, pictures, or in any form other than by spoken words or gestures.
b. the act or crime of publishing it.
c. a formal written declaration or statement, as one containing the allegations of a plaintiff or the grounds of a charge.

2. anything that is defamatory or that maliciously or damagingly misrepresents.

Slander:

Law.defamation by oral utterance rather than by writing, pictures, etc.

Their case of libel is troubling. In truth, both of those definitions are troubling, because of how they conflict on a basic level with free speech. I'm not promoting blatant and groundless defamation of anyone or anything, but...what, we can say whatever we want about anyone, as long as it isn't bad? That should fall on the grounds of proper manners, not LAW. I'm hoping there's some kind of Fair Use-esque law to protect bloggers and legitimate media, or else a lot of bloggers are in for a world of hurt...anyone have info on that? It would be appreciated if you could share it.

Nonetheless, though my experience with Evony doesn't stretch beyond seeing the ads (which, as many said, I feel are...suspect), I have to say their actions are very counter-intuitive and suspicious. I think they'd have been better off just keeping their mouth shut, as it'd have made them look less questionable. Don't you think so?

Ok so let me get this straight, an American company is sueing a British journalist through the Australian legal system. Ok what part of that is supposed to make sense? That's a rhetorical question BTW, I already know the Australian laws favour Evony; but it still seems crazy.
Speaking of which, can Evony really deny any of those things? If they can't honestly deny what Everiss has said about them then I hardly think they have a case; but if it was indeed untrue and he was posting slander, that would be different. Somehow though I doubt that's the case.

Apparently not. From what I've heard the game is some kind of mediocre Civ knockoff, and the suggestive ads are the only thing bringing the people to that place.

I think we should make a paypal account and contribute $2 so this blogger can beat the SHIT out of this case.

This is not good precedence if it is successful. I think it will be thrown out, personally. Evony have literaly just cherry picked an area in the world that has out dated libel laws.

Frankly the Australian courts of that area should probably think of reform 8)

This move to file in AU is shady as hell but I can understand why they are doing it. The U.S. libel laws are so messed up that it's next to impossible for a public figure or company to ever win a libel suit even if it is true, espically if the suit is against a private/suto private citizen. I'm not sure how international libel suits work but I know that filing in the U.S. would be a total waste of time and money for them.

also, the company is right to make the lawsuit, because well, he was saying things that directly concerned the company and he didn´t had facts to rely on...

not really libel does NOT contravene free speech, it's part of the life, liberty and pursuit of happiness. if someone is spread out right lies about you, how can you really live a happy life, depending on what they say you really can't

put it this way if someone went around saying you like to fondle young boys, you wouldn't like it too much. now a few people would think it was totally false, however there would be a few people that would think it's true and treat you differently and that would also have an outcome on your personal life.

Normally I'd step up to the plate here and point out that every business has a right to defend itself against rumours, that bloggers are often loudmouthed jerks with an allergy to research and that rarely is a person in the right just because they're the little guy.

Normally, that is what I would say.

In this case, let these smut-peddling, malware-producing, second-rate human beings burn. Get the guys who did the LEFT4DEAD petition out here and have them whip up a Evony petition. I wonder if a 200,000 man boycott will hurt their numbers as much as Bruce's brave, brave words.

Sue those that sued the truth tellers. call it an "assault on liberty" and hold the case in America; problem solved.

Has evony just given up on the costumed ads and just full force into what is basically pornography? I just saw an Evony ad that was just a shot of a naked girl in a fogged glass shower. There was no Renaissance tie-in, just a straight up naked girl, barely blurred by a shower door. Sex sells, yes, but generally you need a decent product to back it up.

Sometimes it isn't, sometimes it is. Lots of times people use libel lawsuits to harass people who express their opinion of others.

Not entirely a bad point - I know that even baseless accusations can do some damage - but free speech doesn't just protect the good guys. If, say, you wanted to go around saying that very thing about me, you bet your ass I'd refute it, deny it, demand proof...but I wouldn't SUE you. Legally, you have the right to say that. Hell, you have the right to say I'm a necrophiliac Neo-nazi that bathes in baby blood if you wanted.

Besides, think about this - technically speaking, a large number of Youtube comments could constitute a case of libel under these conditions, especially with the racist, homophobic, 100% flame-spreading troll posts you can find on a daily basis. Now imagine how many court rooms across the country, perhaps across the world, would be filled with a pair of bickering dumbasses who made some hateful comment under a music video, claiming 'slander' and 'libel' back and forth. We're not even talking about cases worthy of Judge Judy. And all of that sucking up valuable time and money from the legal process and the taxpayers, knowing some psychotic murderer's court date is waiting behind MCR_rulz_j00's lawsuit.

I don't care how popular suing people is in America. Litigation is an extreme step and should be reserved for serious, truly dangerous situations. If someone sees a post they disagree with, they should ask for proof of their claim before pushing the 'lawsuit' button. This simple, neutral response will weed out the baseless conjecture from the real evidence for all to see.

Oh, and next time, skip the 'life, liberty and the pursuit of happiness' bit. It's a weak and clichéd argument. Besides, if you wanna talk about the American dream, how about the liberty of 'freedom of speech'? How about Evony pulling their heads out of their asses, checking with their lawyers on the past failures of similar cases, and not trying to drag one blogger's livelihood down into the dirt?

Almost every game utilizes attracting female physique to gain costumers. The difference is that Evony use it in their ads, whereas it won't 'interfere' with the game.

So... They're suing this guy because he said truthful things about Evony? I don't think that the creators of Evony realise that this guy said just what everyone is thinking. I mean hell, I saw an ad for Evony last night that bordered on pornographic. They're pushing sex, and badly.

well I`m not surprised by evonies actions. In china, where the owners of evony are from, there is no free speech, if someone says something about your company that you dont like you can just have them shot or have them disappear.
In the real world they can`t do that so they resort to a sleezy lawsuit, that will fail, in a futile attempt to squash free speech in the rest of the world.
Everyone who plays evony and spends money on that game are financially supporting these communist bastards who are attempting to take away our right to free speech.

Here's the thing, they've sued this guy and places (like our beloved Escapist) post about it. Suddenly, a larger number of people know what this man said. What was a potential customer is now most likely never going to buy.

Evony should have just left it alone. It's not like they're EA or Konami, who can get away with doing stupid things and not feel the reaction. This will do nothing but hurt them.

and of course the real kicker is that when evony loses the lawsuit,which they will, it will have the effect of being an admission by evony that everything bruce wrote about them is TRUE!
people who might not ever have heard of evony will now not only have heard of them but will know they are a bunch of communist con artist. This is a no win situation for evony, they really shot themselves in the foot with this lawsuit.

Argh, these libel things. They're really stupid, and basically ban the truth.
