EA Throws Legal Counterpunch at Langdell's Edge

Electronic Arts has filed a counter-suit against Edge man Tim Langdell, accusing him of "fraudulently misrepresenting" himself and his company to the USPTO so that he can keep suing the pants off of everything he sees.

Tim Langdell's shenanigans over the years have been well-documented. As the president of Edge Games he has enthusiastically ladled out legal threats against any and all use of the Edge name, regardless of context, without his permission. The Edge Games website notes that everything from Edge-brand SD cards and PCs from Velocity Micro to Datel's Edge controller for the Wii and even Edge Magazine are all produced under license from Edge. But Langdell's assertions of control over various trademarks have come under attack in recent years, culminating in an effort by industry giant Electronic Arts in September 2009 to have several Edge-held trademarks declared void.

But even when faced with the might and enormity of the EA legal department, Langdell refused to back down. In fact, his response seemed to invite even closer scrutiny of the validity of his claims: He sued Electronic Arts in June for "willful infringement" over its unauthorized use of "Edge" in the game Mirror's Edge. Now, unsurprisingly, EA has fired back, filing a strongly-worded counter-suit that once again seeks to have Edge's various trademarks declared void.

"Through a series of fraudulent misrepresentations to the United States Patent and Trademark Office ('USPTO'), Langdell - a one-time designer of videogames for such long-since obsolete videogame systems as the Amiga, Amstrad CPC, Atari ST, Commodore 64, Oric, and Sinclair ZX Spectrum - has obtained federal registrations for a purported 'family' of Edge marks," the suit says. "Neither Langdell nor his alter ego companies have made any legitimate and good faith use of those marks in commerce, but they have instead used the marks to assert baseless claims against third parties and to extract undeserved settlements, consisting of invalid naked licenses and assignments in gross which Langdell has used to maintain his fraudulently obtained registrations.

"To the extent Counterdefendants ever held a valid registration, they abandoned the mark ... due to non-use of the mark with the intent not to resume use, through an assignment in gross of the application and underlying trademark, and otherwise through a course of conduct that has caused the mark to lose all significance as a mark and/or as an indicator of source," it continues.

EA is seeking the cancellation of the trademark registrations held by Edge Games and "a declaration that [Langdell's] companies have no common law rights in the purported marks that are the subject of those registrations," along with legal fees and whatever other awards the court "deems just and proper." Adding to the drama is the fact that Mirror's Edge 2 is already in the works, further trampling Langdell's (for the moment) trademarks. Stay tuned!

I've been monitoring the Tim Langdell situation for a while now and scincerly hope he gets the legal bitch-slap he has been deserving of for nearly a decade now. The man hasn't actually been involved in making, publishing, distributing or backing a single solitary game since the early 1990s yet someone has the balls to call himself the head of a game development studio known as "Edge games".

Langdell has proceeded to sue everyone in sight over the use of the term 'edge' whist deliberatly attempting to casue confusion between his own (imaginary) products and legit games like Mirrors edge. Between his samefull trademark squatting and lawsuit trolling Langdell finds the time to send imflamitory e-mails to indie developers and generally make a massive swinging dick of himself.

For some unexplainable reason up until 2009 this man was actully a memeber of International Game Developers Association despite his sole source of income at the time seemingly being trolling and harassing other people who were actually doing creative work. The way i like to think of Langdell is like a cross between Bobby.k, a homeless man, a Mob Lawyer and a gaint back full of dicks.

Could this spell the end of the ferocious Edgebeast of Edgingvale?

How the hell does the US Patent Office actually sit there and award someone claim to a single, common-use word like that? It's totally crap.

Besides awarding the full claim to EA, the judge of this case should also throw the book at him, literally throw the damned swearing book (The Bible) at him and hit him in the forehead.

Actually he does have some legal way of continuing. I can't remember exactly what it was...something about funding re-releases of their old games. It was flimsy as hell but it kept them afloat. Now it looks like EA might have found some way to break the loophole and hopefully they do.

I personally hope Tim Langdell has every penny he ever made from a lawsuit forcibly removed from his greedy hands. For bonus points, make him legally forbidden from earning anything above minimum wage for a while.

Not really, this was just the very very short version. There are enough outburts/ incidents/ asshattery that has been done by Mr.Langdell over the years for 3 threads. There is actually a great website that chronicals them all but i've forgotten where i put it.

It's a sad and facepalm enducing saga that has caused many developemt houses undue, undeserved and unjustfied headaches and harassment. The RAGE induced by this mans antics is pretty epic.

Strictly speaking, you cannot copyright "The", now, he did get the copyright, original on "Edge Games", which on its face is fairly legitimate, and then used it to become a copyright bully. He filed suits against the Anthony Hopkins film about fifteen years ago, against the above mentioned Edge Magazine, and so on, claiming that all of them were infringing on his copyrights.

Mirror's Edge is a little more complex. Langdell put a mockup cover of a game supposedly in development called Mirrors, and claimed that EA was deliberately trying to steal his copyright. Now, if I'm remembering correctly, someone sourced the part of an image used to someone's DeviantArt page. Meaning he literally stole someone else's copyrighted work in order to claim that he was working on a project that EA was deliberately trying to undermine. He's since changed the sampled art to something else which, last time I checked, had yet to be identified.

I hope Tim Langdell wins this, and proceeds to sue U2 and World Wrestling Entertainment.

At least he is keeping the lawyers and Court officals fed.

Has he really done something? If he has I haven't heard of them.

EA has a lot of ammo already. Their lawyers have basically been using the evidence that Chaos Edge has been building up over the past year or so in their legal briefs already (which I find rather funny. It's like the Gamers are helping the evil empire bend over the Westboro Baptist church.

This is gonna be good. I hope that once his trademarks have been voided he has to pay back all the money he won from other companies infringing on the "edge" name.

Honestly? In a sane world, EA will get what they want after about ten minutes in court. However, I can't help but feel the worm will wriggle out of EA's stomping boots.
