Motorola Taking Microsoft to Task Over Patent Infringement

Motorola Taking Microsoft to Task Over Patent Infringement

Disagreements over technology has led to Motorola trying to prevent Microsoft from bringing new Xbox 360s into the US.

Motorola has filed a complaint with the United States International Trade Commission, alleging that Microsoft has infringed on a number of its patents with the Xbox 360.

The complaint says that Microsoft has violated section 337 of the Tariff Act of 1930, which specifically deals with the importation of goods into the US that infringe on patents, copyrights or trademarks. The Xbox 360 is manufactured overseas, meaning it is eligible for such a complaint when it enters the country.

Motorola is demanding a cease and desist order, which would prevent Microsoft from importing the goods, and an exclusion order, which would prevent the consoles from entering the country. Whether or not Motorola will get its wish depends on the results of USITC's investigation, which began last week and is likely to conclude early next year.

This complaint comes just weeks after Microsoft sued Motorola over "excessive and discriminatory" patent licensing fees for some of the technology in the 360's wireless LAN adaptor, as well as some of its video codecs.

huh... Didn't people bring the copyright to Sony and won? So now it's Microsoft's turn in the courtroom.

:/ Suing heaven?

There is business in suing people, lets collectivly form a business venture called "Sue the hell out of everyone else. PLC"

"We want more money!"
"No, we pay too much!"
"Its mine!"
"I'll Sue!"
"I'll Sue harder!"

manythings:
"I'll Sue harder!"

That sounds about right. Trying to block all 360's from coming for sale sounds like overreach but it a suing back harder moment.

My god, this is perfect.
Everything that has ever happened on the planet could be condensed into this format.

Thread fucking over guys let's pack this shit up.

But really Motorola? Don't you think you're reaching just a little too far?

If you listen, you'll hear the sound of Nintendo and Sony fanboys cheering in delight.

It's just a matter of time before an out of court settlement and this whole thing blowing over :/

...What just happened?! Seriously...what?!

so motorola a company which just isn't that great anymore is trying to sue megacorporation microsoft and trying to stop imports of xboxes.

first off, how does motorola even think this is sane as to me it sounds as though they would just get laughed out of court.

and secondly, fucking microsoft? this just seems like a terrible idea and is destined to lose.

If this end up at trial Microsoft will lose unless the evidence in overwhelmingly against Motorola. People tend to mark them as the bad guy whenever they get sued any more without even thinking.

The stupidity is rampant here.

Microsoft gets (successfully!) sued like every half-year. Mostly because of their (alleged) exploits of a monopoly.
Not that it really matters to a corporation of this size.

A-MAZING! Realistically, they won't be able to stop systems from entering the country. There would most likely be no basis because of the number of 360's already sold here. This means nothing to gamers, this is just a reason for people to be dramatic. Of course people sue everyone here in America. My guess is, most western type cultures have a lot of the same thing going on. Only, Americans care so much about trivial bullshit, it seems worse.

Patented video codecs?

Fuck you Motorola.

It's funny that all the best stuff is Open Source, there's a REASON for that.

(VLC, Mozilla Firefox, Audacity)

The timing of this lawsuit seems unusual for me. The injunction to stop the import and sale of new Xbox 360s falls on the heels of the end of the holiday shopping season, possibly creating a scare in the amount of available systems for those wishing to capitalize on the new year sales of businesses trying to push merchandise. Could this be a ploy to increase the value of the system if or when this lawsuit succeeds? Not that I want to call a conspiracy here, just starting to sound like one.

OH a evil competition, well sounds mighty exciting!

What? No Activision?

Seriously, Microsoft has always been tight with thier money, and Motorola should have forseen this before even dealing with them. My brother is a tightwad too and you'd never see me going into business with him on anything!

Its just like I was told once;
"There are only 3 real ways to make enough money to not retire broke. Invent the next big thing, Win the Lotto Jackpot, Or Sue someone."

Seems like corporations like taking the easy way out... If only they put half the effort into developing products as they did suing each other. Would also keep the courts free to deal with other cases...

Oh god they don't actually expect this to work do they? >.>

Hang on... What are Motorola suing over anyway? I mean, seriously?

I guess they saw what Apple managed to do against Samsung in Europe?
