Sony Hit With Class Action Lawsuit Over PSN Breach

A class action lawsuit hopes to make Sony pay the piper for the recent breach of PlayStation Network customer information.

A law firm has filed a class action lawsuit against Sony over the potential leak of PlayStation Network users' personal information. The suit aims to collect monetary damages from Sony due to the cost and effort required for these users to replace their passwords and cancel their credit cards.

The Rothken law firm filed the suit in a California district court (the proper place to sue Sony) on behalf of one Kristopher Johns and the other 76,999,999-ish PSN users in the world. It attacks Sony for failing to put proper safeguards in place, which is possibly a breach of the Payment Card Industry Data Security Standard, a set of rules designed to protect consumers from credit card fraud.The suit specifically asks for compensation for the "extra time, effort, and costs" that might have to go into credit monitoring services and replacement.

A Rothken spokesman said: "Sony promised its customers that their information would be kept private. One would think that a large multinational corporation like Sony has strong protective measures in place to prevent the unauthorized disclosure of personal information, including credit card information. Apparently, Sony doesn't."

The big question that remains is whether or not Sony was negligent, or if some kind of super hacker just outsmarted its system. In either case, it's estimated that the breach could cost Sony billions from lawsuits like this, in addition to government-enforced penalties from around the world.

Wow the problems are really starting to pile up for Sony, I wonder how long it will take before I start feeling sorry for them.

Shit is now hitting the fan hard for Sony. Any plans they had for new systems will probably be pushed back for years, giving Nintendo and Microsoft oppertunities to really pull out in the lead in the gaming industry. If this goes down really bad we may never see a PS4. I don't know if it'll be that extreme... but this has been an extreme case.

I'm surprised it took this long to come up. I'm sure there are some people creamed themselves with the thought of legal action after sony told us of the breach.

Do people actually assume that sony only makes game consoles and games? seriously wake the hell up people. Its a major issue other companies have faced before, there is insurance and government options to fix this kind of stuff.

Even though I'm on of the many millions affected by the hack, I can't help but feel sorry for Sony. Everything is going wrong with them all at once. They're gonna need divine intervention to come out of this shitstorm alive.

Hit'em hard I say. PSN has been half-assed since the beginning with the built-in excuse that its free. Small wonder they screwed up at some point. I just wish it was CEOs and VPs that were going to pay for this. Instead, it'll be a bunch of Sony employees who had nothing to do with this. After all, I have a hard time believing a screw up this big came from on high you know?

But people deserve compensation for being put at risk. A guy with an American Express Black card or whatever, could be out like 10,000 - 25,000 bucks. That's pretty signficant.

Sony sucks at minesweeper right? They are sooo going to need an icepack for their wallets. I hope to god they make it a condition that CEOs and the like take the pay cut to pay for this instead of screwing over the workers. C'mon we all know this will lead to massive cut backs and lay offs if they lose unless someone puts a shield up for them.

Well that blows, even I wouldn't call for Sony to be sued. Just put in the proper safeguards next time and be done with it. If it turns out however that credit card info was stolen then good luck to them.

Well, no PS3 was hacked in this case, it was the bank of servers in Sony's headquarters that run the PSN. There are plenty of ways to make something literally impossible to hack into, such as storing sensitive information on a computer not connected to the internet. If Sony didn't have a system for this sort of thing, it could very well be simple negligence.

It's entirely up to you. Personally, I would just cancel whatever cards that you had information stored on PSN with. It's a lot less hassle than nervously checking your account activity every day.

Definitely don't change your card (why put another in danger) and I wouldn't even bother canceling the one you use.
What I would do is call your credit card company and see if they can sign you up to a credit monitoring service if you aren't already. It usually costs a little less than $10 a month and from this it looks like you might be able to get Sony to pay for it... eventually. And if you're already signed onto something like that with another card, that plan probably covers your other cards.

The problem with this isn't so much the credit card (you're insured for that: I wouldn't even worry about the card specifically) but the personal info (name, address, email, and password/security questions if you use the same password/SQ for many things) which can be used to take out credit cards you don't even know about or loans.

Just make sure that you never use your Debit card for things like this and you should be okay. Credit card balances are always insured. The cash in your bank account isn't always insured... even if your bank assures you that it is.

Once again, this advise comes from Frank Abagnale (Catch me if you Can) and that guy is a genius when it comes to this stuff.
