Yes there are laws, and ratings systems, and they aren't allowed to sell to anyone without a valid age ID. But PARENTS buy the games for their children because they are either A. Parents who have taken their child and ensured they are a safe stable individual who understands the difference between fantasy and reality, escapism and responsibility. or B. Total goddamned retards.
The issue falls on the PARENTS. If you want to legislate something, make people take a written test to have a BABY.

Actually, the ESRB rating system is entirely voluntary; there are no statutes that legally limit the sale of videogames to minors. There have been numerous state-level attempts to impose just such restrictions, all of which have been quashed for violating the Constitution. The First Amendment is sacrosanct, and so far the judiciary has had the good sense to see that, even if certain uninformed, reactionary politicians have not.
There has been at least one attempt to do an end-run around the First Amendment by having violent videogames declared "obscene" and therefore exempted from protection in the same way porn is, but that was shot down pretty quickly too as I recall.
All the guys up there make good points about it being the parents responsibilty. Another thing parents do is when and if their kids go postal they usually have this conversation with somebody. "No he never listened to Marillyn Manson and he didn't own a game console but it has to be one of those it couldn't possibly be my parenting.
