Lindsay Lohan Sues Rockstar over Grand Theft Auto V Character Likeness

Lindsay Lohan 310x

Mean Girl files suit against Red Dead Redemption developer over Lacey Jonas similarities.

It took six months, but the rumors are finally proving to be true. Lindsay Lohan has filed a lawsuit against Rockstar Games, in which she claims Grand Theft Auto V character Lacey Jonas is based on her likeness and behavior.

According to the complaint, "The portraits of [Lohan] incorporated her image, likeness, clothing, outfits, Plaintiff's clothing line products, ensemble in the form of hats, hair style, sunglasses, jean shorts worn by the Plaintiff that were for sale to the public at least two years."

Several GTA V missions are based around the Jonas character, and the objectives include celeb-cliche tasks, like assisting in paparazzi evasion.

This isn't the first time an actor/actress has been riled up by a game developer. Ellen Page was none too pleased to see her likeness used for the character Ellie in The Last of Us.

Lacey Jonas could be based on any number of different Hollywood starlets -- Lohan might be the biggest train wreck, but there are plenty of fish in that pond -- but I think Rockstar and Take-Two will end this in a settlement before the year is out.

Unlike Ms Lohan there.

I had no idea she were this desperate for cash. I guess all those hard drugs won't do themselves.

This woman will sue people for anything. I remember a few years back she tried to sue some company for using the name Lindsay in an advertisement. Quick google check. Here it is.

The New York Post reports that Lindsay Lohan is suing E*Trade for $100 million, claiming that the boyfriend-stealing "milkaholic" named Lindsay in the company's Super Bowl commercial above from Grey Advertising was clearly modeled after her. "Many celebrities are known by one name only, and E*Trade is using that knowledge to profit," Lohan's lawyer says. "They're using her name as a parody of her life. Why didn't they use the name Susan? This is a subliminal message.

must be hard to be that narcissistic and think everything is about you. newsflash lindsay, no one's looking for you anymore.

Evidently Lohan doesn't understand the concepts of parody/satire or defamation of character.

Even if she can prove that Rockstar did what she said they did (and they did), it's a parody. Therefore it's entirely legal. Parody movies do it all the time. Games are not different just because they're games.

I just Googled her and I had no idea that she's only 28 years old. She looks way older.

Hey, she's gotta earn a living somehow since The Canyons[1] flopped.

Ah, Ms. Lohan trying to be relevant again. Seriously when will she get the fact that nobody wants her anymore?

Damn I don't even remember who Lacey Jones is and I have played it through twice.

I guess LL is out of drug money and the bums under the local bridge have higher standards.

How could she, when she doesn't even understand the concept of "actually showing up to the filming of movies she's supposed to be in"?

Wasn't that the same case with the coinye thing? And they ended up banning it...

What the hell? Was that a straight-to-video release? I never even heard of it.

Like Rick James said: Cocaine is a hell of a drug.

Long story short, the guy who wrote American Psycho decided to write a movie script and fund the flick with Kickstarter. The actors got paid $100 a day, or so it's said.

Lindsay Lohan was signed as the star fo the movie (for a given value of "star, of course)[2], but didn't bother to show up for filming, since she was too busy partying with Lady Gaga. When the director told her that this was unacceptable and kicked her from the project, she spent a night crying and begging outside his door until he finally let her on again.

It got a straight-to-video on demand release. And also got released in two movie theatres. South by Southwest didn't want it, and the Sundance festival didn't either, since it sucked so much, so that was all the distribution they could get.

[2] The other "star" of the movie was of the porn variety.

Can we cool it with the hate? Drugs are alluring, addictive and easy to find. Lindsey is clean and has been for a while.

Regardless, I thought this was old news.

Seriously, so freaking what if Rockstar DID use her likeness, they do it all the friggin time with their past games and even media itself has been doing it all the time and nobody's suing anyone, unless said artist is desperate for some quick cash.

This I agree with.

Sure, she's being ridiculous, but the drug jokes are just a tad inappropriate.

Fair enough.
As far as it being specifically her likeness, ehh. You could take almost any downward-spiraling "starlet" and say they used her likeness as well. Most likely Rockstar will through her a bone to just make it go away.

So she sees a woman who hires escorts, does drug deals, and engages in high speed chase breakdowns and thinks "Yep, that looks like me!". That can't be a healthy self image.

The drug jokes are too much, I'll give you that. The rest is only fair, though. She's a generally unpleasant person who tries to sue Rockstar because of something ridiculous. If she files a stupid lawsuit, Imma criticize her.

Ellen Page responded only when asked about her likeness and it didn't seem that hostile. Seems like a bad example.

So she IS based on Lohan.

Sure, I just think it's a bit much to make addiction jokes about a women who actually just got free of a debilitating substance abuse problem that seemingly ruined her life. Not to mention the fact that, when you consider her terrible upbringing, it's not that unbelievable that she would turn to drugs and alcohol as a substitute.

Huh, she's going through with it.

Let's see how far she gets.

that one really annoyed me

in that the gaming media blew it WAAAAAAY out of proportion..it was just an off-hand comment from Page..nothing more

See, I'd be wondering if Rockstar's lawyers have played the game. I'd be all willing to admit that they made the drug-doing, perverted sex act-doing character after Lindsey if that's what she wants to hear...

Good luck with that. your not going to get anywhere suing satire for being satire. Rockstar always gets its ass covered, and the likeness is nowhere to be found.

Adam Jensen:
I just Googled her and I had no idea that she's only 28 years old. She looks way older.

wait shes 28? she looked like 40 or 50-but-good-looking-in-hollywood. drugs did their job i guess.

Considering she had showings of horrible attitude in the courthouse, I wonder how it will affect the jury's decision in this matter.

I'd be surprised if the ruling goes toward Lohan's favor.

Don't movies and video games and such have a disclaimer that reads something like, "The characters in this are fictitious and any likeness or similarities are purely coincidence"? Don't they put that in to protect themselves from getting sued?

Now... will it succeed? Probably not. There's a pretty solid defense if Rockstar can show the product was satirical. Having never played the missions in question, I can't say whether that will be an easy lift or not, but no doubt this will probably get settled long before it gets to a jury.

While I can empathize with trying to put one's past mistakes behind oneself, I also can't in a different sense. I didn't lead a public life, forced or by choice. I can only comment on what I know and that is that whatever you do in the past has a way of following you forever. Especially the bad parts, and coming to grips with that, accepting and moving on is a step on the path to recovery. She's ruined her career and long term health, her image is distorted both physically and media-wise by her own actions. At some point one has to say to oneself "I did this. I chose this path." An yes abuse and neglect can factor into why we make bad choices but ultimately we still are the ones making them. There has to be a time where one stops the blaming, stops seeing everything as a personal attack and say "That used to be me, but I'm not that person any longer". Recovery is a tough road and lashing out at any perceived personal attack is a sign you've relapsed or regressed in some manner. Rockstar had no obligation to think about how a parody caricature of a celebrity would affect the real person. Nor did they have to care, nor were they legally barred from emulating real world events (or grossly distorting them). Were that true, any "ripped from the headlines" Law & Order episode would be hit by lawsuits from the parties involved for being too close to reality. And as far as I'm aware, just because you're in prison doesn't mean you can't sue someone (if I'm wrong please tell me). The only thing I can think of is that while Lohan may be clean, she is still seeking attention and acting out which means she's still on the back end of the road to recovery. I feel for her, I really do but ultimately she did this to herself publicly and can't really complain when she's the target of satire. She might as well try to sue Seth Macfarlane for all the jokes his shows have tossed out at her expense. He even used her real name.

Yeah, I think Page was ultimately more upset regarding the controversy from the game she was actually in.

as she should be...I'd be fucking PISSED over that...

I mean I know "well its the internet you can't stop it" but to look at pics with that level of likeness without that persons consent is just wrong to me...even if I do have a girl crush on her

How does south park get away with some of the celebrity bashing they do, yet this case exist on the same planet? I mean I know South Park's legal team is pretty air tight but still. What case does Lohan have that someone like Paris Hilton wouldn't?
