Potential Class Action Suit Against Rockstar Clears Hurdle

Take Two's motion to have a potential class action lawsuit filed in July 2005 dismissed was denied on Thursday by U.S. District Judge Shirley Wohl Kram.

The lawsuit, which is seeking class-action status, alleges that Rockstar violated consumer protection laws by selling Grand Theft Auto games with explicit content under the wrong content label. Take Two, in its request, claimed that the suit was too broad in seeking damages in all 50 states, but Judge Kram rejected the claim writing, in her opinion, "If class certification is granted, the court will have the benefit of a well-defined class and a more fully developed treatment of potential choice of law questions."

Rockstar and Take Two, which had enjoyed recent success in defending the release of the company's latest game, Bully, have been fighting legal troubles from its 2004 release of Grand Theft Auto: San Andreas since the discovery of the "Hot Coffee" scene in 2005.
